An injunction on ASX-listed Dateline Resources’ (ASX:DTR) California-based Colosseum REE and gold project appears set to be lifted after support from the US government’s Departments of Justice and War respectively.

The injunction, originally placed in August of this year, is the subject of an appeal from the US DOJ as reported by Dateline on Monday; on the back of that news, some A$8.9M worth of trades had exchanged hands as of the final two hours of trade on Monday of Week 40.

A stay motion is “expected to be considered” late next month, which would give Dateline the greenlight to move ahead with exploration and mining of its gold and REE project.

Dateline shot to prominence last year when US President Donald Trump directly named the company over social media channels as part of an erstwhile focus on critical mineral supply chains ex-China.

In July of this year, Dateline took a run when the US DOJ moved to get involved in a lawsuit against the company which ultimately led to the injunction the subject of Monday’s disclosure.

“A party seeking a stay pending appeal must ordinarily apply first to the District Court that made the order … for that reason, both the Government’s motion and Dateline’s motion will be heard by Judge Christina A. Snyder, who issued the preliminary injunction on 10 August 2026,” DTR wrote on Monday.

“The motions are listed for hearing on 26 October 2026. If the District Court does not grant a stay, the Company and the Government can then apply to the U.S. Appeals Court for the Ninth Circuit. The appeal itself proceeds in the Ninth Circuit either way.”

The US gov’t issued application pertaining to the potential stay order, penned by the US Department of War Secretary Michael Cadenazzi, highlighted the proximity of DTR’s Colosseum mine to landholdings owned by US-based MP Materials, which last year saw the Trump gov’t buy a stake in the miner. Worth noting: the CEO of MP is a regular Republican donor.

“It is in the United States’ economic and general national security interest to allow exploration for rare earth elements at the Colosseum Mine site to continue,” Cadenazzi wrote.
